Normative Guarantees of the Rule of Law in Disciplinary Proceedings concerning Civil Service Corps Members under the Polish Legal System

The aim of the article is to analyze the normative guarantees of the rule of law in disciplinary proceedings against members of the civil service corps in Poland. The study was undertaken to examine how constitutional and statutory provisions safeguard the rights of participants and limit the arbitrariness of disciplinary bodies. Based on the analysis of legal acts and adjudicative practice, the author highlights the importance of acting strictly on the basis and within the limits of the law, the prohibition of extensive interpretation, and the independence of disciplinary commissions. The results demonstrate that effective protection of the rule of law requires reliance solely on universally binding norms and clarity in decision-making. The article is addressed to lawyers, legislators, and scholars specializing in administrative and constitutional law. The findings open avenues for further research on the effectiveness of appeal mechanisms and the practical independence of disciplinary bodies in the context of rule of law standards.
