Jurisdiction of courts in cases of intellectual property protection
This article discusses jurisdiction of common courts in cases concerning intellectual property – copyright, related rights and industrial property rights. After a historical introduction it focuses on the current legal status introduced as a result of changes in 2005 and 2019. It examines jurisdiction ratione loci [subject-matter]and ratione materiae [space], both general and specific, including the prorogation agreement. The paper also discusses specific provisions, mainly those concerning security proceedings, thus providing a critical analysis of regulations and case law.
