The age of minors and the possibility of transferring them under a European Arrest Warrant. Gloss to the judgment of the Court of Justice of the European Union of 23 January 2018 in the case C 367/16

The gloss concerns a small but significant problem of the principles of respecting juvenile rights within the criminal law context. More specifically, the question is to what extent are the courts executing the European Arrest Warrant obliged to analyze the grounds for refusing to execute the order because of an innappropriate age of a minor for bringing them to criminal responsibility. In the proces of examining the age limits of criminal responsibility, do the courts have to take into account the individual characteristics of the minor and the nature and circumstances of the offense?
